BID-SURPLUS SALE of surplus real prop­erty. Pursuant to the Official Code of GeorgiaAnnotated Sections 36-9-2 and 36-9-3, theBoard of Commissioners of Lincoln County,Georgia, at their regularly scheduled monthlymeeting held on June 8, 2017, declared thefollowing real property as surplus:
All that lot, parcel or tract of land with im­provements thereon, lying and being in theCounty of Lincoln, State of Georgia beingknown and designated as tract “B” containing2.51 acres and being bounded on the Southby “Lincoln County Development Author­ity Remaining Portion real property”, on theEast by property of Westside Holdings, on theNorth by tract “A” containing 2.09 acres, andon the West by Global Drive as is shown ona plat prepared by James F. Mattison IV andrecorded at Plat Book E2017, page 39 in theOffice of the Clerk of Superior Court of Lin­coln County, Georgia, reference being madeto said plat for a more complete and accuratedescription as to said metes, bounds and loca­tion of said property.
Said real property also includes an approxi­mately 23,000 square feet portion of a build­ing currently known as the Office of Emer­gency Services, and known under the currentnumbering system as 1056 Global Drive,Lincolnton, Georgia. See plat for a more com­plete description.
The minimum bid shall be $150,000.00 andno amount less shall be accepted. The success­ful bidder shall immediately present a certifiedcheck made payable to the Lincoln CountyBoard of Commissioners for no less than 10%of the winning bid at the conclusion of the bid­ding process. The 10% payment payable to theLincoln County Board of Commissioners shallbe deducted from the sale price. However, theBoard of Commissioners shall retain the 10%down payment in the event the winning bid­der does not complete the purchase of the realproperty within the required time period. Theremainder of the winning bid amount shallbe paid by certified bank check at the time ofthe closing and transfer of the real property.The closing date for the purchase of the realproperty shall be within 30 days of August 15,2017. These notices shall satisfy two separate butrelated procedural requirements for activitiesto be undertaken by the City of Lincolnton.
REQUEST FOR RELEASE OF FUNDS
On or about August 15, 2017, the Cityof Lincolnton will submit a request to theGeorgia Department of Community Affairs(DCA) for the release of Community Devel­opment Block Grant funds under Title I of theHousing and Community Development Actof 1974, as amended, to undertake a projectknown as 2016 CDBG Sewer Improvements.The project is located in the northeast portionof the city and the target area lies partially onboth sides of US Hwy 378 (N. WashingtonRoad), King’s Way, Goshen Street, and JoanWay. The target area is composed of 85 ben­eficiaries of whom 77 or 90.6% have low tomoderate income (LMI). The new sewer im­provements include 6,125 LF of 8-inch PVCpipe and 28 manholes as a dig and replaceproject. 37 sewer customer households willbe served by 4-inch PVC sewer service lineconnected at the ROW. City will pay for non-LMI income connections.
FINDING OF NO SIGNIFICANT IM­PACT The City of Lincolnton has determinedthat the project will have no significant im­pact on the human environment. Therefore,an Environmental Impact Statement under theNational Environmental Policy Act of 1969(NEPA) is not required. Additional projectinformation is contained in the Environmen­tal Review Record (ERR) on file at Lincoln­ton City Hall located at 125 North PeachtreeStreet, Lincolnton, GA 30817 or at the CSRARegional Commission located at 3626 WaltonWay Extension, Suite 300 Augusta, GA 30909and may be examined or copied weekdays8:30 A.M. to 4:30 P.M.
PUBLIC COMMENTS
Any individual, group, or agency maysubmit written comments on the ERR to theMayor Pro Tem of Lincolnton, Clarence L.(Larry) Goolsby, Jr. All comments receivedby August 14, 2017 will be considered bythe City of Lincolnton prior to authorizingsubmission of a request for release of funds.Comments should specify which Notice theyare addressing.
ENVIRONMENTAL CERTIFICATION
The City of Lincolnton certifies to theDCA, that Clarence L. (Larry) Goolsby, Jr. inhis capacity as Mayor Pro Tem, consents toaccept the jurisdiction of the Federal Courts ifan action is brought to enforce responsibilitiesin relation to the environmental review pro­cess and that these responsibilities have beensatisfied. DCA’s approval of the certificationsatisfies its responsibilities under NEPA andrelated laws and authorities and allows theCity of Lincolnton to use program funds.
OBJECTIONS TO RELEASE OF FUNDS
The DCA will accept objections to its re­lease of funds and the City of Lincolnton’s cer­tification for a period of fifteen days followingthe anticipated submission date or its actualreceipt of the request (whichever is later) onlyif they are on one of the following basis: (a)the certification was not executed by the Cer­tifying Officer of the City of Lincolnton; (b)the City of Lincolnton has omitted a step orfailed to make a decision or finding requiredby HUD regulations at 24 CFR part 58; (c)the grant recipient or other participants in thedevelopment process have committed funds,incurred costs or undertaken activities not au­thorized by 24 CFR Part 58 before approvalof a release of funds by DCA; or (d) anotherFederal agency acting pursuant to 40 CFRPart 1504 has submitted a written finding thatthe project is unsatisfactory from the stand­point of environmental quality. Objectionsmust be prepared and submitted in accordancewith the required procedures (24 CFR Part58, Sec. 58.76) and shall be addressed to theGeorgia Department of Community Affairs at60 Executive Park South, N.E., Atlanta, GA30329-223. Potential objectors should contactthe DCA to verify the actual last day of theobjection period.
