On the 16th day of May 2007, David Estes
Jr., ("Estes) executed a Note for $318,135.60,
payable to Jim Walter Homes, Inc., and on

the 16th day of May 2007, David Estes, Jr.
and Tiffany Estes, executed a Deed to Secure
Debt conveying property described in Exhibit
"A" attached, and recorded in the Office of
the Clerk of Superior Court of Lincoln
County, Georgia, in Deed Book 178, Pages
363-367, both of which were subsequently
assigned to Walter Mortgage Company,
("Walter") by assignment dated February 18,
2009, and recorded aforesaid Clerk's Office.
Default has been made in the payment of
installments due for October 2008, and
subsequent thereto. Walter declared the entire
unpaid indebtedness due and payable in
accordance with the terms of said Note, and
the same has not been paid.
The Deed to Secure Debt provides that
when the Note secured thereby becomes due

undersigned, the party in possession of the
property is Keith M. Theriot or a tenant or
tenants and said property is more commonly
known as 1100 Indian Cove Rd,
Lincolnton, Georgia 30817.
The sale will be conducted subject (1) to
confirmation that the sale is not prohibited
under the U.S. Bankruptcy Code and (2) to
final confirmation and audit of the status of
the loan with the holder of the security deed.

All that tract or parcel of land , with
improvements thereon, situate, lying and
being in the 182nd G.M.District of Lincoln
County, Georgia being shown and designated
as 3.30 acres as shown on a plat prepared for
Gordon Lenox by Bennie C. Harbin, RLS,
dated July 31, 2006 being recorded
simultaneously herewith in the Office of the
Clerk of Superior Court of Lincoln County,
Georgia, in Plat Book 9, Page 683. Reference
being made to said plat for a more complete
and accurate description as to the metes,
bounds and location of said property. Also
included in this transfer is a 1985 24x52
Horton Mobile Home, GEO 299324 and GEO
299325, Identification Number H29901 GR
A Side and H29901 GL B Side "which, by
intention of the parties shall constitute a
part of the realty and shall pass with it". This
being the same property as that conveyed to
Gordon J. Lenox and Rebecca L. Lenox by
deed of Helen Hutto Scott dated August 21,
2002 which was recorded on August 26, 2002
in said Clerk' s Office in Deed Book 127,
Page 48.
