Hinesley presides over waived jury trials

Waived jury trials were held Monday and Tuesday, December 15 and 16, at the Lincoln County Courthouse, with Judge Harold A. Hinesley presiding.

The following cases were disposed of during the proceedings:

.. Nathaniel Leverett pleaded guilty to simple battery and was sentenced to 12 months probation and a $500 fine plus surcharges. He was further ordered to continue rehabilitation.

.. Kathy Ann Rhodes pleaded guilty to running a disorderly house and received 12 months probation and a $1,000 fine plus surcharges. She was also ordered not to allow children to have parties at her home.

In addition, Rhodes was granted first offender status by the court, which means that if the defendant meets all of the terms and conditions of probation, she will be discharged under the first offender law, with no criminal record.

.. James Allen Kelly pleaded guilty to theft by taking (misdemeanor) and was sentenced to 12 months probation. He was further ordered to make restitution in the amount of $53.83.

The defendant was granted first offender status by the court.

.. Angela Tutt pleaded guilty to Violation of the Georgia Controlled Substances Act (VGCSA [possession of cocaine]); DUI; and Violation of the Open Container Law.

On the first charge, she was sentenced to four years probation, a $1,000 fine plus surcharges, and the drug package.

The drug package is a special condition of probation which provides for drug treatment and counseling as well as random testing. It also requires the defendant to submit to searches of his person and/or property upon request.

On the DUI charge, Tutt received 12 months (24 hours in confinement, with the balance on probation); a $450 fine plus surcharges; and 40 hours community service. She was likewise ordered to attend a driver's risk reduction course.

Concerning the third charge, the defendant was sentenced to 12 months probation and a $150 fine plus surcharges.

The court granted Tutt first offender status.

.. Jimmy Ray Ellison pleaded guilty to two counts of theft by taking (felony) and two counts of criminal trespass.

He was sentenced to 10 years probation and $500 fine plus surcharges on each of the theft charges. He was also ordered to pay restitution.

On each of the criminal trespass charges, the defendant received 12 months probation and a $500 fine plus surcharges.

All of the sentences will run concurrently.

.. Kevin Eugene Morgan pleaded guilty to fleeing or attempting to elude a police officer, driving with a suspended license, and Violation of the Open Container Law.

He was sentenced to 12 months probation and a $250 fine plus surcharges on the first charge; 12 months probation and a $500 fine plus surcharges on the second charge; and 12 months probation and a $150 fine plus surcharges on the third charge.

.. Vonnie Eugene Andrews pleaded guilty to theft by taking (misdemeanor) and received 12 months probation, a $500 fine plus surcharges, and 50 hours community service. He was further ordered to make restitution to the victim in the amount of $80.

.. In a trial before the court, Charles Dean Ware was found guilty of VGCSA (possession of cocaine) and was sentenced to five years probation, a $1,000 fine plus surcharges, and the drug package.

.. In a trial before the court, Jessie Lee Allen Meaders was found guilty of obstruction of an officer and received 12 months probation and a $250 fine plus surcharges.

.. Charles Bobby Grubbs, Jr. pleaded guilty to theft by shoplifting (misdemeanor) and was sentenced to 12 months probation and a $300 fine plus surcharges.

.. Tina Marcelle Grubbs pleaded guilty to VGCSA (possession of methamphetamine) and received six years probation, a $1,200 fine plus surcharges, and the drug package.

In a separate case, the defendant pleaded guilty to VGCSA (possession of marijuana [misdemeanor]) and was sentenced to 12 months probation and a $300 fine plus surcharges.
