Sealed proposals will be received by Lincoln County, Georgia in the Courtroom of the Lincoln County Courthouse located at 210 Humphrey Street, Room 201, Lincolnton, Georgia until 3:00 p.m. local time on April 10, 2006, and will be publicly opened and read at that time in the Courtroom, Room 201 of the Lincoln County Courthouse, 210 Humphrey Street, Lincolnton, Georgia. No submitted bid may be withdrawn after the scheduled closing time for receipt of bids for a period of sixty (60) days.

All bids shall be personally delivered and must be placed in a plain envelope and sealed. This plain sealed envelope must then be placed inside of another sealed envelope with the words "Bid opening for C.E. Norman Road, Lincoln County, Georgia at 3:00 p.m. local time April 10, 2006." No bids will be accepted after 3:00 o'clock p.m. on April 10, 2006.

Bids will be submitted and awarded on either a line item basis or on a total bid basis.

WORK TO BE DONE: The work to be done consists of furnishing all materials, equipment and labor for the basing, paving, and striping of 3.500 miles on the C.E. Norman in Lincoln County, Georgia. The work will consist of 815 tons recycled Asph Cone Leveling, including bituminous material; 2,909 tons recycled asphaltic concrete 9.5 MM superpave Group 1 or 2, including bituminous material; 1,862 GL Bitum Tack Coat; 7.00 LM of 5 inch white solid traffic stripe; 6.130 LM of 5 inch yellow solid traffic stripe; 0.880 GLM of 5 inch yellow skip.

Time allotted for the completion of this work shall be 120 consecutive days. Penalty of $500.00 per day will be assessed for each day the contract is not completed within the allotted time.

Proposals shall be submitted to Walker T. Norman, Chairman, Lincoln County Board of Commissioners, or his lawful designee, Lincoln County Courthouse, 210 Humphrey Street, Room 201, Lincolnton, Georgia.

Each proposal shall be accompanied by a Bid Bond drawn in favor of Lincoln County, Georgia, in the amount of at least five percent (5%) of the lump sum bid for the completed work; such Bid Bond representing that the bidder, if awarded the contract, will promptly enter into a contract and furnish Performance Bond and Payment bond as provided by law and approved by the County Attorney for Lincoln County, Georgia. Performance Bond is 100% of bid. Payment bond is 105% of the bid. The Bid Bond shall be forfeited to Lincoln County, Georgia as liquidated damages if the bidder fails to execute the contract and provide Performance and Payment Bonds within ten (10) days after being notified that he has been awarded the contract.

The successful bidder shall comply with the provisions of O.C.G.A. Sections 50-24-1 through 50-24-6 relating to the Drug-Free-Workplace Act.

The County will insure that disadvantaged business enterprise contractors will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, national origin, sex, age or disability in consideration for an award.

By virtue of the power of sale contained in that certain Deed to Secure Debt from Michael Anthony Parks and Melissa Parks to Booker T. Whereas, heretofore, on July 30, 2004, Jerry W. Laughlin and Hong Thi Laughlin, did make and execute to Henry F. Beckworth and Shirley M. Beckworth a certain Security Deed covering the following described property:

Tract I

All that lot or parcel of land with improvements thereon, situate, lying and being in the State of Georgia, County of Lincoln and being known and designated as Lot 29, Block H, Indian Cove Subdivision of Kimberling Investment Corporation land within the Clark Hill Reservoir Area as shown on a plat prepared by James G. Swift, P.E., Augusta, Georgia, dated March 12, 1963 and which plat is recorded in Plat Record 3, Page 2, in the Office of the Clerk of the Superior Court of Lincoln County, Georgia. Reference is hereby made to said plat for a more complete and accurate description as to metes, bounds and location of said property.

Said property is conveyed subject to Protective Covenants applicable to said subdivision of record in said Clerk's Office in Deed Book 23, Pages 257-258.

Said property is conveyed subject to any and all easements of record, if any.

Tract II

All that tract or parcel of land, with any improvements thereon, situate, lying and being in the 182nd District, G.M. Whereas, said Security Deed was given to secure a Note of even date therewith in the amount of FORTY-NINE THOUSAND AND NO/100 ($49,000.00) DOLLARS, all as shown by said Security Deed recorded in the office of the Clerk of Superior Court of Lincoln County, Georgia, in Deed Book 140 at pages 510-511; and,

Whereas, the said Note has become in default as to the payment of installments due thereon and the undersigned elects that the entire Note, principal and interest, become due and payable at once.

Now, therefore, according to the original terms of said Security Deed and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash, the above described property, after proper advertisement, on the first Tuesday in April, 2006, between the legal hours of sale, before the Courthouse door in Lincolnton, Lincoln County, Georgia. The proceeds from said sale will be used to pay the costs and expenses of said sale, to pay the indebtedness secured by said Security Deed and to pay the surplus, if any, to the person or persons legally entitled thereto.
