Lear Benning Tutt has petitioned to be
appointed Administrator of the estate of
Clarence Tutt, deceased, of said County. The
petitioner has also applied for waiver of bond
and/or grant of certain powers contained in
O.C.G.A. 53-12-232. All interested parties
are hereby notified to show cause why said
petition should not be granted. All objections

Middle/High School, Metasville-Lovelace Rd,

Bids will be received by the Lincoln County
School District (Owner) at the office of the
Lincoln County Board of Education
(Attention Dr. Randall Edmunds), 423
Metasville Rd, P.O. Box 39, Lincolnton, Ga.
30817, until 11 a.m. local time, Tuesday,
August 5, 2008.
The bids will be publicly opened and read
aloud at teh conference room of the Lincoln
County Board of Education, 423 Metasville
Rd, Lincolnton, Ga. 30817 at 11 a.m. local
time, Tuesday, August 5, 2008.
Bid documents may be reviewed at the
F.W. Dodge Plan Room, the Augusta Builder's
Exchange or the office of the engineer.
The work consists of site clearing, grubbing
and grading, erosion of sediment control best
management practices, building pad
construction, athletic track and fields
construction, utility installation, fencing,
landscaping, paved parking areas, and
roadway construction for a new middle/high
school.
Due to the size and complexity of this
project and the time frame for completion,
it is imperative that all interested parties
attend a pre-bid conference. A mandatory
pre-bid conference will be held at the
Conference Room of the Lincoln County
Board of Edcuation, 423 Metasville Rd,
Lincolnton, Ga. on Tuesday, July 22, 2008
at 10 a.m. Prospective bidders not attending
the pre-bid conference will not be allowed to
submit bids on the Project.
Bidding documents may be obtained at the
office of the engineer, Onesource
Development, LLC, 4210 Columbia Rd, Suite
16-A, Martinez, Ga. 30907. Applications for
documents, together with a deposit of $300
per set, shall be filed promptly with the
Engineer. Bidding material will be forwarded,
shipping charges collect, as soon as possible.
An amount of $100 per set will be refunded
to each General Site Contractor who submits
a bona fide bid if documents are returned in
good condition within thirty (30) days after
opening of bids.
Contract, if awarded, will be on the basis
stated in the Instructions to Bidders. No bid
may be withdrawn for a period of 35 days
after time has been called on the date of the
opening of bids.
Bids must be accompanied by a Bid Bond
made payable to the Lincoln County School
District in the amount not less than five
percent (5%) of the lump sum bid for the
complete work; such Bid Bond representing
that the Bidder, if awarded the contract, will
promptly enter into a contract agreement
and furnish a Performance Bond and
Payment Bond as provided by law and
approved by the Attorney for the Lincoln
County School District. Each bond shall be
equal to one hundred percent (100%) of the
contract amount. The Bid Bond will be
forfeited to the Lincoln County School
District as liquidated damages if the Bidder
fails to execute the contract and provide
Performance and Payment Bonds within ten
(10) days after being notified that he has
been awarded the contract. Certified Checks
or Letters of Credit are not acceptable. A
Surety Company licensed to do business in
the State of Georgia and listed in the
Department of the Treasury Circular 570,
latest edition, must execute bonds. The Surety
Company shall have an A.M. Best Company
rating of "AAA" with a financial size of IV
"4" or better. Bonds must be accompanied
by a letter stating bonding company's current
rating for verification prior to acceptance
by the Owner and execution of the formal
Owner/Contractor Agreement. Contractor
and Subcontractor shall require the Attorneyin
Fact who executes bonds on behalf of
sureties to attach a certified current copy of
his Power of Attorney.
Contractors shall submit to the Owner the
completed "Statement of Bidders
Qualifications Form" attached to the
Proposal Form at the time of the bid. The
successful bidder must be prepared to submit
within five (5) days of Owner's request a
properly executed AIA Document A-305 with
a current audited/reviewed Financial
Statement (both to be less than one year
